Terms and conditions

These Agency Terms govern the contractual relationship between you as the guest (hereinafter referred to as the “Client”) and The Balearian – Villas & Concierge, owner Florian Settele, Palma de Mallorca, Spain (hereinafter referred to as “The Balearian”).

The Balearian acts as an intermediary for holiday accommodations in the Balearic Islands on behalf of and for the account of the respective property owners.
By making a booking, you acknowledge and accept these Agency Terms as binding.

1. Role of The Balearian
The Balearian acts exclusively as an intermediary and is neither a tour operator nor a landlord.
The rental agreement is concluded directly between you and the respective property owner.
The Balearian acts in the name and on behalf of the owner and is entitled to accept and forward bookings and payments.

2. Booking & Contract Formation
By submitting a booking request via The Balearian, you make a binding offer to conclude a rental agreement with the property owner.
The rental agreement is concluded upon booking confirmation issued by The Balearian.
For bookings made via online platforms (e.g. Airbnb, Booking.com), the respective platform terms and conditions apply in addition.

3. Payment Terms
For direct bookings via The Balearian, the following payment terms apply unless otherwise agreed:
30% deposit of the rental price due upon booking confirmation
Remaining balance payable no later than 40 days prior to arrival
For bookings via online platforms, only the respective payment and settlement terms of the platform apply.

4. Security Deposit & Damages
For direct bookings, a security deposit may be required. The amount and payment details are specified in the booking confirmation.
Refunds are generally made within 14 days after departure.
Justified deductions for damages, insufficient cleaning, or extraordinary wear and tear remain reserved.
For bookings via Airbnb, damage handling is carried out exclusively through Airbnb’s AirCover program.
AirCover does not constitute an insurance contract but a host damage protection program. A separate cash deposit may therefore be waived or reduced depending on platform conditions.

5. Cancellation & Withdrawal Policy
The applicable cancellation and withdrawal conditions depend on the booked accommodation and the corresponding property group (e.g. Mallorca or Ibiza) as stored in the booking system of The Balearian (vOffice). The only binding conditions are those displayed during the booking process, in the offer, or in the booking confirmation within the booking system.

For accommodations assigned to the Mallorca property group, the following flat-rate cancellation fees apply, unless different conditions are stored in the booking system. The fees are based on the agreed total rental price: up to 90 days before arrival 30%, 89–60 days before arrival 50%, 59–30 days before arrival 75%, from 29 days before arrival, in the event of no-show or early termination 100%.

For accommodations assigned to the Ibiza property group, different cancellation and withdrawal conditions apply as stored in the booking system, which generally provide for a deposit of 50% of the total rental price payable immediately after booking. In the event of cancellation, the paid deposit is non-refundable unless otherwise stated in the booking system.

Regardless of the property group, individual accommodations may be subject to different cancellation and withdrawal conditions specified by the owner. In such cases, only the conditions stored in the booking system and displayed during the booking process are binding.

For bookings made via online platforms such as Airbnb, Booking.com or FeWo-Direkt, only the cancellation and withdrawal conditions displayed on the respective platform at the time of booking apply. These conditions always take precedence over the cancellation conditions of The Balearian.

6. Services, Defects & Liability
The Balearian is liable solely for the proper mediation of the booking, not for the performance or quality of the accommodation itself.
Any defects or complaints regarding the accommodation must be reported immediately to the property owner or their local representative.
The Balearian shall not be liable for disruptions, damages, or changes beyond its sphere of influence, in particular due to weather conditions, utility outages, or actions of third parties.

7. Concierge Services & Additional Services
Additional services such as private chefs, catering, transfers, yacht charters, wellness treatments, housekeeping services, or experiences may be:
organised directly by The Balearian, or
arranged through selected professional third-party providers.
We deliberately work with experienced specialists who are fully dedicated to their respective fields and who collaborate with proven, high-quality partners.
Contracts for additional services are concluded directly between you and the respective service provider.
The payment, cancellation, and liability terms of the service provider apply.
The Balearian assumes no liability for third-party services but is happy to assist with coordination and organisation.

8. Data Protection
The Balearian processes personal data exclusively for the purpose of booking management in accordance with the General Data Protection Regulation (GDPR) and applicable Spanish data protection laws (LOPDGDD).

9. Property Information & Limitation of Liability
Images, descriptions, amenities and technical features do not constitute guaranteed characteristics unless expressly confirmed in writing. The Balearian assumes no liability as an intermediary for incorrect or amended information provided by the property owner, to the extent permitted by law.

10. Governing Law & Jurisdiction
Spanish law shall apply exclusively.
To the extent legally permissible, the place of jurisdiction is Palma de Mallorca.

11. Supplementary Spanish Legal Clause
Cláusula de Derecho Aplicable (resumen en español):
Este contrato se rige por el Derecho español. Cualquier controversia será sometida, en la medida legalmente posible, a los Juzgados y Tribunales de Palma de Mallorca.
